3 Instances When You Shouldn't File a Personal Injury Lawsuit

Blog

If you have recently been in some sort of accident, you might be wondering if you have a good case for filing a personal injury lawsuit. You may see people in the media, or even friends and family who have filed a lawsuit and had a positive outcome. Although there are many circumstances where a lawsuit would be warranted, there are also situations where you shouldn't file a lawsuit. Here are a couple times when you should not file a lawsuit.

1. You Can Resolve It with the Insurance Company on Your Own

In many cases you can resolve any problems that you have with the insurance. If you have been in a car accident and you have a good deal of medical bills that need to be covered, you should first file with the insurance company to see what they will do for you. Make claims for each medical bill and see what happens. In many cases, the insurance company will simply pay out your bills so that you don't have to worry about going broke with all your medical expenses.

If the insurance company is being reasonable, then you have very few reasons to file a lawsuit. A lawsuit is about getting restitution for damages. If the insurance company or other party is trying to make good on those injuries, that should be enough.

2. You Are Filing for Personal Reasons

You should never make a lawsuit personal. This is one of the most dangerous situations, and could end up costing you more money and time because you were seeking revenge on someone. Your attorney and the judge will have very little sympathy for the person who wants to hurt another with a lawsuit. You need to have facts, and numbers on your side. If you make it emotional, you are likely to lose.

3. The Amount of Money Involved Is Small

If you have a case that is only worth a couple thousand dollars, you might consider filing a claim in small claims court and avoid filing a full lawsuit. Although some lawyers will take your case based on contingency, many lawyers will charge by the hour. This means that you will probably pay a good deal of money in legal fees. So if you are only expecting to win a couple thousand dollars in winnings, you will probably use all of your winnings to pay the attorney.

These are just three times when you should avoid filing a personal injury lawsuit. For more information, talk to a lawyer like Owen Law Firm.
